The case of Delta Development Group

On December 28, 2021, the Georgian National Competition Agency completed the investigation conducted based on the complaint of "Delta Development Group" Ltd. submitted on April 26, 2021, concerning an alleged violation of Article 11(3) of the Law of Georgia "on Competition" (Prohibition of the unfair actions of undertakings) by 5 companies operating in the field of translation service.


The investigation confirmed the violation of Article 11(3) of the Law of Georgia "on Competition" by 2 respondent undertakings: Tbilisi Business House Ltd (ID: 404482608) and Tbilisi Business House Ltd (ID: 204564293). The violation was followed by the illegal use of the ISO 9001: 2015 certification and the relevant IQNET logo in business and commercial relations, which, according to the Agency, is the presentation/advertising of the company by spreading false information.

“Algorithm” Ltd. Case

On July 20, 2021, the Georgian National Competition Agency has completed the investigation based on the complaint of Algorithm Ltd (s / n: 205043237) regarding the unfair competition by Algorithm Ltd (s / n: 402084980). As a result of the investigation, it has revealed the violation of paragraph 2(a) - provision of information about goods by any means of communication (including, through improper, unfair, unreliable, or clearly false advertising), which misleads consumers and encourages them to perform certain economic actions, of the Article 113– Prohibition of the Unfair Actions of Undertakings of the Law of Georgia on Competition, which was manifested in the presentation/advertising of the product in a way that misleads the consumers. Finally, based on the decision of the Agency, the respondent "Algorithm" Ltd (ID: 402084980) has been instructed to avoid the risk of confusion between it and the applicant company and misleading the customer during conducting the advertising policy of the company.

On April 27, 2021, the Georgian National Competition Agency completed the investigation conducted based on a complaint submitted by "Free Spirit Tours" Ltd. relating to an alleged violation of Article 11 (3) (Prohibition of the unfair actions of undertakings ), paragraph 2, sub-paragraph e (receipt, use or dissemination of scientific-technological, production or trade information or commercial secrets without the consent of their owner) of the Law of Georgia "on Competition" by "Sphinx Travel" Ltd.

Based on the conducted investigation, the fact of unfair competition by "Sphinx Travel" Ltd has not been confirmed.

The Case of “Insurance Company Aldagi”

On October 30, 2020, the Georgian Competition Agency has completed an investigation conducted based on a complaint of JSC “Insurance Company Unison”, alleging that the Batumi regional representative of JSC Aldagi Insurance Company had damaged the competitor's reputation.


The investigation revealed the violation of the Article 113 (Prohibition of the unfair actions of undertakings) paragraph 2, C ((undermining by an undertaking of a competitor’s business reputation (by creating an incorrect impression regarding the undertaking, products, entrepreneurial or trade activities), its unreasonable criticism or discrediting)) of the Georgian Law on Competition, specifically, this concerned the dissemination of information damaging the reputation of JSC Insurance Company Unison by the representative of JSC "Aldagi Insurance Company" via official e-mail. Finally, JSC "Aldagi Insurance Company" was instructed to immediately ensure the denial of the spread information by sending an official letter to "Caucasian Metals Terminal" Ltd. and to provide JSC "Insurance Company Unison" and the Georgian Competition Agency with the information about the action.

The case of “GT Motors” Ltd

On September 14, 2020, the Georgian Competition Agency has completed the investigation conducted based on a complaint of "G-T Motors" Ltd. related implemented advertising activities by "G.T. Motors" LTD, which misled the customer.


The investigation revealed the violation of the Article 11(3) (Prohibition of the unfair actions of undertakings) paragraph 2, A (provision of information about goods by any means of communication (including, through improper, unfair, unreliable or clearly false advertising), which misleads consumers and encourages them to perform certain economic actions)of the Georgian Law on Competition by the "G.T. Motors" LTD. However, during the investigation, "G.T. Motors" LTD eliminated the fact of competition violation. In particular, all disputed advertisements posted on the Internet were brought into compliance with Competition Law. Finally, with the confirmation of the fact of violation of the competition legislation, "G.T. Motors" LTD was instructed to run its advertising company in the future in such a way as to avoid confusion between it and the applicant company and to mislead the customer.

CASE OF LTD “DAZGA”

LTD “DAZGA” submitted a complaint to the Competition Agency regarding the unfair competition conduct by LTD “SOLWAY.” According to the complainant, LTD “SOLWAY” misguided users by using the webpage, with the “GE domain”, analogical to the one belonging to LTD “DAZGA” (dazga.ge). The Agency considered the conduct of LTD “SOLWAY” as unfair competition act and obliged the company to discontinue the violation.

CASE OF LTD “DESIGN HOUSE”

LTD “DESIGN HOUSE” submitted a complaint to the Competition Agency regarding the unfair competition conduct by “DNA.” According to the complainant, “DNA” distributed information, disruptive of the reputation and interest of LTD “DESIGN HOUSE,” via social media - Facebook. The Competition Agency considered the Conduct of “DNA” as unfair competition act and obliged the alleged party to remove the Facebook posts, providing wrong information to users regarding LTD “DESIGN HOUSE.”

CASE OF “ITECHNICS” LTD “ITECHNICS” submitted a complaint to the Competition Agency regarding the unfair competition conduct by LTD “IPLUS.” As a result of investigation, unfair competition conduct by LTD “IPLUS”, namely the episode of www.itechnics.ge, was detected. The Agency obliged the company to discontinue the violation.

Virsaladze Institute of medical Parasitology and tropical medicine” submitted a complaint to the Competition Agency regarding the unfair competition conduct by LTD “Research Institute of Medical Parasitology and Tropical Medicine.” According to the complainant, the alleged party distributed information via Facebook.com disruptive of the reputation of the complainant, bribing its staff, and etc. As a result of investigation, the Agency established a violation fact and obliged the alleged party to discontinue the violation.
